The South African Police Service (SAPS) has confirmed that disciplinary proceedings against Lieutenant General Sibiya remain underway, despite parallel legal proceedings currently before the Labour Court.

According to SAPS National Spokesperson Brigadier Athlenda Mathe, the disciplinary process has not been halted and continues separately from the court matter.

The disciplinary hearing was heard on Tuesday, during which the applicant requested a postponement. The request was granted, with the matter now set down for 12 October 2026. The postponement will afford the applicant an opportunity to consult with his legal representatives and prepare for the continuation of the hearing.

At the same time, the urgent application before the Labour Court was heard and subsequently adjourned. The adjournment will allow SAPS to file its opposing papers and provide the applicant with an opportunity to submit a replying affidavit before the matter returns to court.

Brigadier Mathe stated that the disciplinary hearing and Labour Court proceedings are distinct processes that have been running concurrently.

SAPS further indicated that the Labour Court matter remains sub judice and, as a result, the organisation will not comment on the merits of the case while it remains before the court.

The police service reiterated that both the disciplinary and legal processes will be allowed to proceed in accordance with established legal and administrative procedures.
